Terms of Service

1. Introduction

Welcome to YTScribe ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

2. Definitions

  • Service: The YTScribe website and all services provided therein, including but not limited to transcript generation, translation, and AI summaries.
  • User: Any individual who accesses or uses our Service.
  • Account: A registered profile that allows personalized use of certain features of our Service.
  • Free Tier: Basic services offered at no charge, with limitations.
  • Premium Tier: Enhanced services offered for a subscription fee, with additional features.
  • Content: Transcripts, translations, summaries, or any other material generated or provided through our Service.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of uppercase and lowercase letters, numbers, and symbols) with your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription Plans

We offer Free and Premium subscription tiers. By subscribing to our Premium tier, you agree to the following:

  • You authorize us to charge your payment method on a recurring basis for your subscription.
  • Subscriptions will automatically renew for the same term unless canceled at least 24 hours before the end of the current period.
  • You can cancel your subscription at any time through your account settings.
  • Prices for our services are subject to change with notice. We will notify you before implementing any price change.
  • No refunds will be issued for partial subscription periods or unused features.

5. Intellectual Property

Our Service and its original content (excluding Content provided by users or derived from third-party sources such as YouTube), features, and functionality are and will remain the exclusive property of YTScribe and its licensors.

With respect to the transcripts, translations, and summaries provided through our Service:

  • Transcripts are generated from YouTube videos and their original content remains subject to YouTube's Terms of Service and the respective content creator's rights.
  • Users retain rights to their saved transcripts, summaries, and other Content generated at their request.
  • We grant users a personal, non-exclusive, non-transferable license to use the Content for personal, non-commercial purposes.

6. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by YTScribe. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that YTScribe shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

By using our Service, you agree to comply with the YouTube Terms of Service as our Service utilizes the YouTube API Services.

7. User Conduct

You agree not to use our Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service.
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
  • Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
  • Otherwise attempt to interfere with the proper working of the Service.

9. Data Processing Addendum

For users subject to GDPR, by using our Service you agree that YTScribe acts as a data processor for the personal data you submit to our Service. We will process this data only in accordance with your instructions and our Privacy Policy. This includes:

  • Processing your data only for the purpose of providing our Service.
  • Ensuring all staff with access to your data have committed to confidentiality.
  • Implementing appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
  • Assisting you, as the data controller, in responding to requests from data subjects.
  • Notifying you without undue delay in case of a personal data breach.
  • Upon termination of services, deleting or returning all personal data as requested.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall YTScribe, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

YTScribe does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

We do not guarantee the accuracy, completeness, or usefulness of transcripts, translations, or summaries. The AI-generated summaries are provided for convenience and may not be comprehensive or entirely accurate.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
